At least in Canada the maximum you can sue for is around $100,000. I think. I'm not really sure on the exact number, but you can't just sue for millions here. There are exceptions, but they're rare.1

Actually, I think it has to be based on the actual cost to the plaintiff + estimated legal fees + a small amount (less than either of those two) for inconvenience, as opposed to cost + punitive damages * 3 (why three? I don't know).

Really, I think the difference comes from the cost to the plaintiff should they lose: they will pay the defense's legal fees...
